These Terms of Service (“Terms”) govern access to and use of DigitalJusticeConsulting.com and all related websites, memberships, software, downloads, databases, tools, materials, communications, and services offered by Digital Justice Consulting (“DJC,” “we,” “us,” or “our”).

By accessing or using DJC, creating an account, purchasing or maintaining a membership, downloading or using software or materials, submitting information, uploading content, or otherwise using any DJC service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use DJC.

1. Eligibility

DJC is intended solely for adults who are at least eighteen (18) years old.

Individuals under the age of eighteen (18) are not permitted to access, create an account on, purchase from, subscribe to, upload information to, or otherwise use DJC.

By using DJC, you represent and warrant that you are at least eighteen (18) years old and legally capable of entering into a binding agreement.

2. Nature of DJC Services

DJC provides educational, informational, research, organizational, and self-help resources concerning unwanted telephone calls, text messages, electronic communications, consumer-protection laws, litigation, evidence preservation, dispute resolution, and related matters.

DJC services may include, without limitation:

  • Educational articles and guides;
  • Research materials;
  • Software and downloadable tools;
  • Templates and sample documents;
  • Calculators and organizational tools;
  • Court documents and public records;
  • Information concerning lawsuits, settlements, companies, telephone numbers, and communications;
  • Member-only databases;
  • Newsletters and alerts;
  • User-submitted information;
  • Other educational and self-help resources.

DJC may add, modify, suspend, restrict, or discontinue any service, feature, tool, database, software product, or resource at any time.

3. No Attorney-Client Relationship

Digital Justice Consulting is not a law firm and does not provide legal representation.

DJC does not act as your attorney, and no attorney-client relationship is created by accessing the website, purchasing a membership, communicating with DJC, using software or templates, downloading materials, submitting information, or using any other DJC service.

Information and materials provided through DJC are provided for educational, informational, research, organizational, and self-help purposes and are not a substitute for advice from a licensed attorney.

You are responsible for determining whether professional legal advice is appropriate for your circumstances.

4. No Guarantee of Results

DJC does not guarantee any particular legal, financial, procedural, settlement, or litigation result.

Past settlements, judgments, recoveries, demand amounts, statutory damages, case outcomes, or other results do not guarantee similar results in another matter.

The outcome of any dispute may depend upon numerous factors, including facts, evidence, applicable law, jurisdiction, procedure, opposing parties, judges, courts, defenses, deadlines, and circumstances outside DJC’s control.

DJC does not guarantee that any person will:

  • Recover money;
  • Obtain a settlement;
  • Prevail in litigation;
  • Avoid liability;
  • Obtain a favorable ruling;
  • Successfully identify a responsible party;
  • Establish a legal violation;
  • Obtain any particular damages award or other relief.

5. User Responsibility

You are solely responsible for decisions you make concerning your own claims, disputes, correspondence, negotiations, filings, litigation, evidence, and legal rights.

You are responsible for independently reviewing all documents before signing, filing, serving, sending, publishing, or relying upon them.

DJC is not responsible for errors caused by inaccurate, incomplete, misleading, or outdated information supplied by a user.

6. Legal Deadlines

DJC does not undertake responsibility for monitoring or preserving legal deadlines on your behalf.

You are solely responsible for determining and complying with all applicable:

  • Statutes of limitation;
  • Filing deadlines;
  • Service deadlines;
  • Court dates;
  • Administrative deadlines;
  • Appeal deadlines;
  • Discovery deadlines;
  • Evidence-preservation obligations;
  • Notice requirements;
  • Other time-sensitive legal requirements.

No statement, calculator, software tool, template, article, or other DJC resource should be relied upon as a guarantee that a particular deadline has been correctly calculated.

7. Memberships

DJC may offer paid memberships that provide access to member-only information, software, databases, downloads, tools, research, templates, documents, communications, or other resources.

Unless expressly stated otherwise, a membership provides a limited, personal, revocable, nonexclusive, and nontransferable right to access designated DJC services while the membership remains active and in good standing.

Membership does not transfer ownership of any DJC intellectual property.

DJC may modify membership benefits as services develop.

8. Subscription Billing and Automatic Renewal

Where a membership is offered on a recurring basis, the membership will renew at the stated billing interval until canceled.

By purchasing a recurring membership, you authorize the applicable payment processor to charge the payment method provided for each renewal period until cancellation.

Pricing, renewal frequency, and material subscription terms will be disclosed at or before purchase.

DJC may change future membership pricing upon notice where required by applicable law.

9. Cancellation

Members may cancel recurring memberships using the cancellation process made available by DJC.

Cancellation prevents future renewal charges but does not ordinarily entitle the member to a refund for an already-paid membership period except where required by law or expressly stated otherwise.

Unless otherwise stated, access may continue through the end of the period for which payment has already been made.

10. Refunds

Unless otherwise stated at the time of purchase, payments for memberships, digital products, downloadable materials, software, databases, or other immediately accessible digital services are nonrefundable once access has been provided.

Nothing in these Terms limits any refund or cancellation right that cannot lawfully be waived.

DJC may voluntarily issue a refund or credit without creating an obligation to provide similar relief in another matter.

11. Accounts and Account Security

Users who create accounts are responsible for:

  • Providing accurate information;
  • Maintaining the confidentiality of login credentials;
  • Preventing unauthorized access;
  • Promptly notifying DJC of suspected compromise;
  • All activity occurring through their accounts to the extent permitted by law.

Accounts and membership credentials may not be sold, transferred, shared, sublicensed, or made available to unauthorized persons.

DJC may suspend accounts where fraud, abuse, unauthorized access, credential sharing, or other violations are reasonably suspected.

12. Member-Only Content

Member-only materials may include software, databases, court documents, research, templates, guides, reports, settlement information, telephone-number information, company information, or other resources.

Unless expressly authorized, members may not:

  • Republish substantial portions of member-only content;
  • Resell or sublicense access;
  • Share membership credentials;
  • Circumvent access controls;
  • Scrape or systematically extract databases;
  • Redistribute protected software or downloads;
  • Create competing databases using systematic extraction of DJC data;
  • Make member-only resources publicly available.

13. Software and Downloads

Unless a separate license provides otherwise, DJC grants authorized users a limited, revocable, nonexclusive, nontransferable license to use DJC software, templates, utilities, downloads, and digital materials for lawful personal use.

Users may not:

  • Resell or commercially redistribute DJC software;
  • Circumvent licensing or access controls;
  • Remove ownership or copyright notices;
  • Falsely represent DJC software as their own;
  • Redistribute modified DJC software under DJC branding without authorization;
  • Use DJC software for unlawful purposes.

DJC does not warrant that software will be error-free, uninterrupted, compatible with every operating system or device, or suitable for every purpose.

Third-party software is governed by the terms imposed by its provider.

14. User Uploads and Submissions

DJC may permit users to submit or upload information or materials, including:

  • Telephone numbers;
  • Text messages;
  • Emails;
  • Screenshots;
  • Call logs;
  • Recordings;
  • Correspondence;
  • Demand letters;
  • Court documents;
  • Pleadings;
  • Settlement information;
  • Company information;
  • Case information;
  • Public records;
  • Photographs;
  • Other documents, data, or evidence.

You are solely responsible for determining whether you have the legal right to upload, disclose, distribute, publish, or authorize DJC to use any material you submit.

DJC’s acceptance of an upload does not constitute a determination that the submission is lawful.

15. Prohibited Uploads

You may not knowingly submit material that:

  • You have no legal right to possess or disclose;
  • Violates a court order or protective order;
  • Violates a confidentiality or nondisclosure obligation;
  • Violates a lawful settlement restriction;
  • Infringes copyright, trademark, privacy, publicity, or other legal rights;
  • Contains knowingly false defamatory factual statements;
  • Contains malware or malicious code;
  • Contains stolen passwords or authentication credentials;
  • Is submitted for an unlawful purpose.

Users should avoid uploading Social Security numbers, full financial-account numbers, passwords, authentication credentials, or other unnecessary highly sensitive information.

DJC may reject, remove, redact, restrict, quarantine, or delete submitted material.

16. License to Submitted Materials

When you submit material for publication, database inclusion, research, analysis, comparison, reporting, or community use, you grant DJC a nonexclusive, worldwide, royalty-free license to store, reproduce, organize, analyze, redact, summarize, format, display, publish, distribute, and otherwise use that material as reasonably necessary for the purpose for which it was submitted.

You retain ownership of your original material.

Material submitted solely for private storage, support, or another clearly designated private purpose will not be intentionally published merely because it was uploaded.

17. Representations Regarding Submitted Material

By submitting material to DJC, you represent and warrant that:

  1. You have the legal right to submit the material;
  2. Your submission does not knowingly violate applicable law;
  3. Your submission does not knowingly violate another person’s enforceable rights;
  4. You have disclosed any known restrictions that materially affect DJC’s lawful use of the material;
  5. Information presented by you as factual is, to the best of your knowledge, accurate.

18. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Digital Justice Consulting and its owners, officers, employees, contractors, agents, affiliates, licensors, service providers, successors, and assigns from and against claims, demands, causes of action, liabilities, judgments, damages, losses, penalties, fines, expenses, costs, and reasonable attorneys’ fees arising out of or relating to:

  • Material, information, documents, recordings, photographs, screenshots, communications, data, court filings, or other content you upload, submit, publish, or provide;
  • Your representation that you possess the legal right to submit or authorize use of submitted materials;
  • Claims that your submitted material infringes copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights;
  • Claims for defamation, false light, invasion of privacy, unlawful disclosure, or similar causes of action arising from material supplied by you;
  • Your violation of a court order, protective order, confidentiality obligation, settlement agreement, nondisclosure agreement, or other binding restriction;
  • Your unlawful use of DJC services, software, databases, information, or materials;
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your conduct in connection with any claim, dispute, demand, lawsuit, or proceeding in which you use DJC information or resources.

DJC may, at its own expense, assume control of the defense of any matter otherwise subject to indemnification. You agree to reasonably cooperate in the defense.

This indemnification provision does not require indemnification to the extent prohibited by applicable law.

19. Public and Member Databases

DJC may maintain public or member-accessible databases containing information concerning:

  • Telephone numbers;
  • Telemarketers;
  • Businesses;
  • Lead generators;
  • Marketing entities;
  • Lawsuits;
  • Court filings;
  • Settlements;
  • Complaints;
  • Regulatory actions;
  • Public records;
  • User-reported experiences;
  • Other relevant information.

Information may be obtained from public records, government records, court records, businesses, users, members, third parties, or other lawful sources.

Inclusion in a DJC database does not necessarily mean DJC has independently verified every statement associated with the entry.

20. Settlement and Case Information

DJC may publish or provide information concerning lawsuits, demands, settlements, judgments, court filings, or other disputes where DJC lawfully possesses the information.

Settlement information may be based upon user reports, public records, documents, or other sources.

Users should independently verify information before relying upon it for litigation, settlement, valuation, or other decisions.

21. Requests for Correction

A person or business that believes objectively factual information published by DJC is inaccurate may request correction.

Requests should identify:

  • The specific information challenged;
  • The claimed inaccuracy;
  • Supporting information or documentation;
  • The requested correction.

DJC may investigate and may correct, annotate, restrict, supplement, or remove information as appropriate.

DJC is not required to remove accurate public records, protected opinions, lawfully reported experiences, or other information merely because a person or business objects to its publication.

22. Acceptable Use

You may not use DJC to:

  • Violate applicable law;
  • Commit fraud;
  • Harass or unlawfully threaten another person;
  • Impersonate another person;
  • Gain unauthorized access to an account or computer system;
  • Upload malware;
  • Interfere with DJC operations;
  • Circumvent security or access controls;
  • Scrape restricted databases;
  • Distribute spam;
  • Misuse personal information;
  • Facilitate unlawful conduct.

23. Intellectual Property

Unless otherwise stated, DJC owns or licenses its branding, logos, original written materials, original software, databases, graphics, templates, website design, compilations, and other proprietary materials.

Nothing in these Terms transfers ownership of DJC intellectual property to a user.

Use beyond the license expressly granted by DJC requires authorization or another legal basis.

24. Third-Party Content and Services

DJC may refer to, recommend, discuss, or link to third-party websites, products, businesses, software, courts, government resources, payment processors, service providers, or other external resources.

DJC does not control third parties and is not responsible for their content, accuracy, availability, security, privacy practices, products, services, or policies.

Use of third-party services is subject to their own terms and policies.

25. Affiliate and Referral Relationships

DJC may receive referral fees, commissions, advertising compensation, or other benefits from certain products or services identified on the website.

Where disclosure is required by law, DJC will disclose applicable material relationships.

Compensation does not guarantee or alter the performance of a third-party product or service.

26. Communications

Users may receive communications concerning:

  • Accounts;
  • Memberships;
  • Payments;
  • Renewals;
  • Security;
  • Services;
  • Software;
  • New resources;
  • Newsletters;
  • Research;
  • Site updates.

Marketing communications may be discontinued using available unsubscribe procedures.

Transactional, billing, security, membership, account, and service-related messages may continue where reasonably necessary.

27. Service Availability

DJC does not guarantee uninterrupted availability.

Services may be interrupted by maintenance, software failure, hosting problems, third-party outages, network failures, cybersecurity incidents, updates, power failures, or circumstances outside DJC’s reasonable control.

DJC may modify or discontinue features without guaranteeing permanent availability of any particular resource.

28. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, DJC AND ITS SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

DJC DISCLAIMS EXPRESS AND IMPLIED WARRANTIES INCLUDING, TO THE EXTENT PERMITTED BY LAW, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, COMPATIBILITY, AND SECURITY.

Nothing in these Terms excludes a warranty or right that applicable law does not permit to be excluded.

29. Limitation of Liability

To the fullest extent permitted by law, DJC and its owners, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to DJC services.

This includes, to the extent permitted by law, losses allegedly arising from:

  • Reliance on information;
  • Lost or unsuccessful claims;
  • Missed deadlines;
  • Lost data;
  • Software failure;
  • Business interruption;
  • Lost profits;
  • Third-party conduct;
  • Unauthorized account access;
  • Court decisions;
  • Settlement decisions.

Where liability cannot lawfully be excluded, liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded.

30. No Duty to Pursue Claims

Providing information, research, software, forms, templates, tools, databases, or other resources does not obligate DJC to:

  • Represent you;
  • File an action for you;
  • Communicate with an opposing party;
  • Negotiate on your behalf;
  • Send a demand on your behalf;
  • Appear in court;
  • Conduct discovery;
  • Monitor your case;
  • Pursue or finance litigation.

31. Mandatory Pre-Suit Notice and 90-Day Opportunity to Cure

Before commencing any lawsuit or other civil proceeding against Digital Justice Consulting arising out of or relating to DJC, this website, a membership, account, transaction, payment, service, privacy matter, software product, download, communication, database, user submission, or other interaction with DJC, you must first provide DJC with written notice of the dispute and allow DJC ninety (90) days from receipt of the notice to investigate, respond, correct any error where appropriate, and attempt to resolve the dispute.

The notice must be sent to:

The notice must provide sufficient information to identify:

  1. The person asserting the dispute;
  2. The account, transaction, communication, event, service, or conduct involved;
  3. The material facts supporting the dispute;
  4. The legal or contractual basis asserted, if known;
  5. The relief requested.

You agree not to commence a civil action against DJC until the ninety-day period has expired.

Failure to comply with this pre-suit notice requirement may be asserted by DJC as a basis to seek dismissal, stay, abatement, or other appropriate relief to the fullest extent permitted by law.

Nothing in this provision prevents a person from contacting or cooperating with a government agency or regulator, and nothing requires delay where applicable law prohibits enforcement of a pre-suit notice requirement or where immediate judicial relief is legally necessary to prevent irreparable harm.

32. Informal Resolution

During the ninety-day period, the parties may communicate in an attempt to resolve the dispute informally.

Neither party is required to accept a settlement or relinquish a valid claim merely because informal resolution is attempted.

33. Governing Law

These Terms and disputes arising from DJC services are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

34. Exclusive Venue and Jurisdiction

To the fullest extent permitted by law, any lawsuit, action, or other judicial proceeding arising out of or relating to DJC, these Terms, the website, any membership, transaction, account, service, software, download, database, communication, user submission, or other interaction with DJC must be brought exclusively in a court of competent jurisdiction serving Humboldt County, California.

For matters within state-court jurisdiction, exclusive venue shall be in Humboldt County, California.

Where a claim is subject to exclusive federal jurisdiction, venue shall be in the federal court having proper jurisdiction over Humboldt County, California.

By using DJC, you consent to personal jurisdiction in the foregoing courts and, to the fullest extent permitted by law, waive objections based upon venue, forum non conveniens, inconvenience, or similar grounds.

Nothing in this section waives a right or jurisdictional requirement that applicable law does not permit the parties to waive.

35. Termination and Suspension

DJC may suspend, restrict, or terminate access where reasonably necessary because of:

  • Violation of these Terms;
  • Fraud;
  • Abuse;
  • Threats;
  • Security concerns;
  • Unauthorized redistribution;
  • Credential sharing;
  • Nonpayment;
  • Unlawful activity;
  • Conduct reasonably harmful to DJC, its systems, or other users.

Termination does not eliminate obligations that accrued before termination.

36. Survival

Provisions that by their nature should survive termination will continue to apply, including provisions concerning intellectual property, user submissions, indemnification, disclaimers, limitation of liability, governing law, venue, dispute resolution, and accrued payment obligations.

37. Changes to These Terms

DJC reserves the right to modify, amend, supplement, or replace these Terms at any time, in its discretion, with or without prior notice, except where notice or affirmative consent is required by applicable law.

Revised Terms will be posted on the website with an updated effective date. Where required by applicable law, DJC will provide additional notice or obtain consent before revised Terms become binding.

Your continued use of DJC after revised Terms become effective constitutes acceptance of the revised Terms to the fullest extent permitted by law.

Changes will apply prospectively unless otherwise permitted by applicable law.

38. Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

Where legally permitted, an invalid provision may be modified to the minimum extent necessary to make it enforceable while preserving its intended purpose.

39. No Waiver

DJC’s failure to enforce any provision of these Terms does not waive the right to enforce that provision or any other provision later.

40. Assignment

You may not assign or transfer your rights or obligations under these Terms without DJC’s written consent.

DJC may assign or transfer its rights and obligations in connection with a merger, acquisition, sale, reorganization, transfer of assets, or similar business transaction, subject to applicable law.

41. Entire Agreement

These Terms, together with the Privacy Policy and any additional written terms applicable to a particular service, membership, purchase, software product, or transaction, constitute the agreement governing use of DJC.

If specific written terms applicable to a particular service conflict with these general Terms, the more specific terms control with respect to that service.
